Gurgaon police on Wednesday registered a case against an army major for allegedly assaulting a food distribution administrator after an argument in a community in Gurgaon in September last year. The FIR was registered after the district court directed the station house officer (SHO) of Kerki Daula police station to register an FIR in the matter last week.
According to the police, the incident took place in September 2021 when the complainant Sonu (27) from Churu, Rajgarh taluka, Rajasthan, who worked as a food delivery executive in Gurgaon, went to deliver food. A community in Sector 81, Gurgaon.
“When I entered the society’s tower around 9.45 pm, the security guard asked me to use the service lift. When I was about to board the lift, the security guard started abusing me and there was an argument over whether to use the service lift or another lift for residents,” Sonu said in the complaint. “Hearing the noise, a resident of the tower came. The resident said he was a Major in the Indian Army. He started beating me. He said ‘mei bada admi han’, threatened to throw him in jail and told him to get lost. He slapped me and I suffered hearing loss due to the injury to my eardrum,” the complaint added.
The complainant said that he lodged a complaint at the Gergi Daula police station on September 9, 2021, but as no action was taken on the complaint, he approached the district court.
On hearing the matter, on September 15, 2022, the Chief Judicial Magistrate in an order said, “…this Court considers that this is a fit case for registration of FIR under Section 156(3) CrPC. The contents of the complaint disclose the commission of a cognizable offense by the accused for which, in the opinion of this Court, an FIR should be registered under relevant Sections 323, 341 and 506 of the Indian Penal Code. Therefore, in view of this, SHO PS Kherki Daula, Gurugram is directed to register an FIR in the present complaint under the aforesaid sections of the Indian Penal Code, 1860. [within] A week’s time.”
“As per the directions of the court, an FIR has been registered and investigation has started,” a police official said.
An FIR under sections 323 (intentionally causing hurt), 341 (wrongful restraint) and 506 (criminal intimidation) of the Indian Penal Code has been registered against the accused at Kergi Daula police station, police said.
